02What data we process
We process only data that you provide to us yourself or that is generated when you use the website:
- Identification and contact data: first name, last name, company, Company ID, email, phone.
- The content of your inquiry or message, and the project budget and timeline.
- Data from our contractual relationship: billing details, communications, project materials.
- Job applicant data from the application form on the website: name, email, phone, résumé, link to a profile or portfolio, and the application text.
- Technical data from the website: IP address, browser type, device, and cookie data according to your consent.
03Purposes and legal bases
- Handling your inquiry, price calculation and preparing a proposal: steps taken prior to entering into a contract, Art. 6(1)(b) GDPR.
- Performing the contract (development, hosting and maintenance, marketing): performance of a contract, Art. 6(1)(b).
- Accounting and taxes: legal obligation, Art. 6(1)(c).
- Protecting our legal claims and securing the website: legitimate interest, Art. 6(1)(f).
- Commercial communications to existing clients: legitimate interest under Section 7 of Act No. 480/2004 Coll.; you can unsubscribe in every email.
- Recruitment and keeping your résumé for future positions: steps taken prior to entering into a contract; for longer retention, consent, Art. 6(1)(a).
- Analytics and marketing cookies: consent, Art. 6(1)(a) GDPR and Section 89(3) of Act No. 127/2005 Coll.
04How long we keep data
- An inquiry that did not lead to a project: 2 years from the last contact.
- Contract documentation and communications: for the term of the contract and 4 years after it ends (limitation period).
- Accounting records: 10 years under the Czech VAT Act and Accounting Act.
- An applicant's application and résumé: 6 months after the recruitment process ends (no longer than 1 year from the application); with consent to retention, 2 years from the application. You can withdraw consent at any time.
- Cookies: for the period stated in the Cookie policy; we remember your consent for 12 months.
05Who we share data with
We do not sell your data. We share it only with processors that help us run our business, only to the extent necessary and under a data processing agreement:
- Hosting and infrastructure: Vercel Inc., Neon Inc.
- Sending emails from website forms: Plus Five Five, Inc. (the Resend service).
- Business email and DNS: Websupport, s.r.o.
- Analytics and advertising (only with consent): Google Ireland Limited (Google Analytics 4 and Google advertising features).
- Our accountant and tax advisor, and our attorney.
- Public authorities, where required by law.
06Transfers outside the EU
Some processors are based in the USA. Transfers take place on the basis of the European Commission's adequacy decision (EU-U.S. Data Privacy Framework) or standard contractual clauses. Our Orlando branch handles the data of EU clients under the same conditions.
07Your rights
At any time, you can:
- request access to your data and a copy of it,
- request correction of inaccurate data,
- request erasure if we no longer need the data,
- request restriction of processing,
- receive your data in a machine-readable format (portability),
- object to processing based on legitimate interest and to direct marketing,
- withdraw your consent as easily as you gave it; for cookies, on the Cookie settings page.
08How to exercise your rights and where to complain
Email info@listify.cool or send a message to our data box (ID: 7s75zvs). We will respond without undue delay and within 1 month at the latest.
If you are not satisfied, you can lodge a complaint with the supervisory authority, the Czech Office for Personal Data Protection (ÚOOU), Pplk. Sochora 27, 170 00 Praha 7, Czech Republic, www.uoou.gov.cz.
09Automated decision-making
We do not make decisions about you based solely on automated processing, and we do not carry out profiling with legal effects. The price calculator on the website gives only a ballpark estimate; a person always prepares the proposal.
10Security and changes
We protect data with encrypted transmission (HTTPS), access control, two-factor authentication and regular backups. We may update this policy; the current version is always on this page.
